Az ÉMKK Zrt-nél, a KKSZ Területi Szervezete és a KMSZ aláírta a társaság egységes kollektív szerződését úgy, hogy arról a Szabolcs Szatmár Bereg Megyei Közlekedési Szakszervezet, már csak az aláírás után, a tegnapi napon értesült. Mindezek tudatában megállapítható, hogy a munkáltató az SZSZBMKSZ-t kizárta a tárgyalásokból. Mivel az SZSZBMKSZ a kollektív szerződés tervezetét nem kapta meg, arról a véleményét sem tudta megfogalmazni és módosítási javaslatait közölni a munkáltatóval.

Az is érthetetlen, hogy a kollektív szerződés tervezetének tárgyalására mikor és milyen körben került sor, és ezekre a tárgyalásokra, egyeztetésekre az SZSZBMKSZ képviselőjét a munkáltató miért nem hívta meg. Értesüléseink szerint, a tárgyalásokról készült dokumentumokat, az SZSZBMKSZ a napokban ki fogja kérni.

Miért volt szükség a kollektív szerződés ilyen hirtelen aláírására? Talán azért mert az SZSZBMKSZ ha egyesül a SZAKSZ-al és az jogutód szervezete lesz, nehogy beleszólhasson az egységes kollektív szerződés tárgyalásába és esetleges aláírója legyen a régiós kollektív szerződésnek.

Ez egyértelműen joggal való visszaélés, vagyis a munkáltató és az aláíró szakszervezetek együtt rendeltetésellenesen gyakorolták az Mt. hatályos jogszabályát. Az aláíró szakszervezetek ezt miért tették? Annyira kifogástalan és a munkavállalók számára is előnyös szerződéskötésre került sor? Majd kiderül!

Tisztában van a KKSZ és a KMSZ azzal amit csinált és vállalja-e majd ennek következményeit? Magatartásuk magyarázható majd azzal, hogy a szabálysértő szerződéskötés egyértelműen a munkavállalók érdekeit szolgálta?

Ugyanis, ha ez a procedúra „tisztességesen” került volna lebonyolításra, akkor az SZSZBMKSZ képviselőjét is – az anyag megküldésével egy időben – meg kellett volna hívni a kollektív szerződés tervezetének tárgyalására, akkor is, ha az SZSZBMKSZ a 300 fős tagságával – jelenleg még – nem kollektív szerződést kötő szakszervezet.

Információink szerint az SZSZBMKSZ az AKSZSZ jogi képviselőjével megvizsgáltatja a „titokban” megkötött kollektív szerződés aláírásának körülményeit és ha kell megteszi a szükséges jogi lépéseket, a kollektív szerződéskötés jogszerüségével kapcsolatban.

Az aláíró szakszervezetek miért nem hozzák nyilvánosságra, a 2015. március 5. napján aláírt régiós bérmegállapodást és a fent említett kollektív szerződést? Nyilvánvalóan ennek is megvan az oka!
