Párhuzamosan ezzel az alvállalkozásban foglalkoztatott összes munkavállaló a napokban feljelentést tesz a NAV-nál ismeretlen tettes ellen, mivel az alvállalkozó számos adójogszabályt megsértve és sikkasztás alapos gyanúja alapján jelentős károkat okozott az általa foglalkoztatott munkavállalóknak. A feljelentéssel a munkavállalók szeretnék elkerülni, hogy az adóhatóság a későbbiekben rajtuk kérjen számon olyan mulasztást, jogszabálysértést, amit nem követtek el.
A Nemzeti Adó és Vámhivatal a 2012. október 16-án tett feljelentésünk alapján, elrendelte a nyomozást és a SZAKSZ elnökét 2013. január 21. napján, a nyomozó hatóság tanúként hallgatja meg azzal kapcsolatban, hogy történt-e büntetőjog szempontjából értékelhető mulasztás a GEMENC VOLÁN Zrt. bármely munkavállalója részéről, az alvállalkozó működése során, a munkavállalóknak és a költségvetésnek okozott károkkal kapcsolatban. Azt is tisztázni érdemes, hogy abban az esetben, ha az alvállalkozó Gemenc és Környéke Busz Kft., nem jelentette be az autóbuszvezetőket, vagyis három hónapig feketén foglalkoztatta a munkavállalókat – amire már az alvállalkozónál volt példa -, hogy lehetett ennek az alvállalkozónak az alvállalkozói díjat havonta átutalni.
