A mai napon, 2013. augusztus 24-én Kaposváron a Gemenc Volán Zrt. képviseletében Miszler Miklós személyforgalmi és marketing igazgató, a SZAKSZ részéről, Dobi István elnök, valamint Dávid György Tolna megyei elnök részvételével, a szakszervezet által, 2013. július 29. napján kezdeményezett konzultációt, az érintett felek lefolytatták. A munkáltató és a szakszervezet között megállapodás a konzultáció során nem jött létre, az eredménytelenül végződött.
A Gemenvc Volán Zrt. képviselője nem értett azzal egyet, hogy a Tolna megyei Munkaügyi Felügyelőség megállapítása, ami azt tartalmazta, hogy 398 fő autóbuszvezető esetében, a Gemenc Volán nem tartotta nyílván a munkavégzéshez kapcsolódó előkészítő és a befejező tevékenységhez szükséges 15-15 perc munkaidőt, az azt is jelentené, hogy a társaság, arra az időre nem számolt el munkaidőt és munkabért a munkavállalók számára.
A SZAKSZ elnöke ezzel szemben azt állította, hogy a vizsgálatból egyértelműen kiderült, hogy a munkáltató a fel és a lelépési időket nem megfelelően számolta el, azzal az autóbuszvezető teljes napi jelenléti idejét nem növelte, így erre nem is fizetett munkabért.
Mivel a munkáltató nem ismerte el mulasztását és utólag nem hajlandó a munkavállalókkal elszámolni, a szakszervezet jogsegélyszolgálatának képviseletével, a munkavállalók jogi útra terelik követelésük rendezését. Abban az esetben, ha a Munkaügyi Bíróság igazat ad a munkavállalóknak, 3 évre visszamenőleg kell a munkáltatónak az elmaradt munkabért kifizetni, ami 398 autóbuszvezető esetében közterhek nélkül a 80 M Ft-ot is meghaladhatja, a Gemenc Volánnál.
