A mai napon a Kaposvári Közigazgatási és Munkaügyi Bíróság, az első fokon meghozott ítéletében hatályon kívül helyezte a DDKK Zrt. által, az elmúlt év szeptemberében a fekete pólós demonstrációban résztvevő autóbuszvezetőkkel szemben meghozott – egyéb hátrányos jogkövetkezménnyel járó – határozatokat, amit több érintett szakszervezeti tagunk a bíróságon megtámadott.
A fekete pólós demonstráció után, a DDKK Zrt. által meghozott határozatokkal kapcsolatos munkáltatói magatartást a bíróság rendeltetésellenes joggyakorlásnak mínősítette és azt jogellenesnek ítélte.
Ismételten bebizonyosodott, hogy a SZAKSZ jogsegélyszolgálatának biztosításával minden olyan munkáltatói határozatot, ami a munkavállalók számára hátrányos és elfogadhatatlan, ráadásul még jogsértő is, azt az illetékes bíróság előtt meg kell támadni.
Bátran kimondhatjuk, hogy ismételten győzött az igazság és megint pert vesztett a munkavállalókkal szemben egy munkáltató!
Az elmúlt héten az ÉMKK Zrt. is visszavonta azokat a korábban meghozott kártérítési határozatokat, amiben üzemanyag túlfogyasztás miatt okozott kár megtérítésére kötelezett több autóbuszvezetőt. A határozatokat az ÉMKK Zrt. azután vonta vissza, miután az érintett autóbuszvezetők a SZAKSZ jogsegélyszolgálatának képviseletével, az illetékes bíróságon a határozatok hatályon kívül helyezését kérték.
Mindkét eset az bizonyítja, hogy a munkáltatók döntése nem minden esetben mondható korrektnek és törvényesnek.
