A Törvényszék megállapította, hogy a SZAKSZ nem sértette meg a szakszervezet honlapján megjelent cikkével, az ÉMKK Zrt. jóhírnévhez fűződő személyiségi jogát. A Törvényszék szerint helyesen állapította meg az első fokú bíróság ítéletében, hogy a SZAKSZ a cikkében sem valótlan tényállítást, sem való tény hamis színben történő feltüntetése nem valósult meg.
